Western New York U.S. District Court

John Leonard Sinatra, Jr., was born in 1972 in Buffalo, New York. He earned his undergraduate degree from the University at Buffalo, and his Juris Doctor from the University at Buffalo Law School. He clerked for the New York Court of Appeals and litigated for a multinational law firm.

Sinatra was appointed to the office of the Department of Commerce’s general counsel. He returned to private practice.

President Donald Trump nominated him for district judge in 2018. The nomination was returned to the president in 2019, who renominated Sinatra later that spring. The Senate confirmed him after invoking cloture in December, and he received his judicial commission days later.

U.S. District Judge John Sinatra ruled a New York law unconstitutional that made it illegal to have a firearm on private property without consent of the property owner. The judge issued an injunction against parts of the Concealed Carry Improvement Act of 2022, deciding that the Second Amendment applies to private property that is open to the public.

The judge ruled, “The Constitution requires that individuals be permitted to use handguns for the core lawful purpose of self-defense… And it protects that right outside the home,“ the judge ruled. “Nothing in the Nation’s history or traditions closes the door on that right across all private property open to the public.

Citing Bruen, Judge Sinatra wrote, “New York’s restriction ‘violates the Fourteenth Amendment by preventing law-abiding citizens with ordinary self­ defense needs from exercising their right to keep and bear arms.‘

The judge denied the state’s request for a stay pending appeal.
